Thank you again for coming back to me and for your patience for a response following me being away last week.

 

Unfortunately Sussex Police would still not be able to support the type of operation that you are proposing. We maintain our position that there is increased risk of crime & disorder in the Lewes Road area and that any additional licensable activity into the early hours is a potential risk. For your reference, Police Licensing did raise representations against the REDACTED

application, although it was ultimately granted by the Licensing Committee.

 

Therefore, as mentioned before, you are within your rights to submit your application with the hours and operating schedule that your business requires, and have it heard by a Committee if Police raise a representation. The Panel can then weigh up all they hear from both sides and make an independent decision.

 

If you do make an application, we can of course continue to communicate during the 28 day consultation period.

Dear Claire,

Thank you for your detailed response and for providing the city’s Statement of Licensing Policy and Sussex Police's perspective. I appreciate the insights regarding late-night operations within the Special Stress Area and the concerns raised regarding potential risks.

Having considered your observations, we would like to propose a compromise for our application:

 Dine-in and walk-in services: We are willing to close our premises to dine-in and walk-in customers at 1:00 AM daily.

 

 Delivery operations: We would continue operating delivery services only until 2:00 AM, ensuring that our business supports the needs of our community while minimizing disruption or risks associated with late-night activity.

We are also keen to demonstrate how we will mitigate any potential risks associated with operating in the Special Stress Area. To that end, we propose the following measures:

1.        Enhanced Security Measures:

 

Deployment of CCTV systems covering the interior and exterior of the premises, monitored in real-time to ensure swift action against any disorderly behavior.

 

Implementation of staff training to manage interactions with intoxicated individuals, should the situation arise.


2.        Collaboration with Local Authorities:

 

A commitment to report any disorderly or suspicious activities to Sussex Police promptly.

 

 Regular communication with local authorities and community groups to address concerns and adopt best practices.

3.        Controlled Late-Night Access:

 

 Restricting late-night access to the premises post-1:00 AM for walk-ins and implementing a strict delivery-only model to reduce foot traffic and associated risks.

We also wish to highlight that other establishments, such as KFC on London Road, operate in a similar capacity within a Special Stress Area with licenses extending to 3:00 AM. This precedent suggests that with the appropriate mitigations in place, late-night operations can coexist successfully with the goals of the Statement of Licensing Policy. We believe our proposed closing time of 1:00 AM for dine-in, paired with delivery-only operations until 2:00 AM, presents a balanced and responsible approach.

Regarding Ramadan, while we appreciate the use of Temporary Event Notices (TENs) during this period, our intent is to provide consistent and reliable service to our community year-round. The flexibility to operate until 2:00 AM aligns with this mission while supporting a culturally inclusive approach.

We respectfully request that our application be considered on these revised terms, and we are happy to discuss additional steps we could take to further align with licensing and public safety objectives.

Thank you for your detailed response. I would like to make a few observations taking note of the city’s Statement of Licensing Policy (which I have attached for your reference) as well as Sussex


Police local crime and disorder knowledge.

Generally new premises licence applications for Late Night Refreshment, even without alcohol, in the Special Stress Area (which Lewes Road sits inside) until 02:00 would not be supported by Sussex Police. Premises open into the early hours of the morning attract their own unique issues and even if they are not themselves serving alcohol, may have to deal with intoxicated persons. Would you consider closing the premises to walk ins/seated customers at a certain time daily and moving to a delivery only operation?

Turning to Ramadan and the late night hours being needed for that. We have a number of other premises in the city who serve the community in this way and they use Temporary Event Notices (TENs) to extend their hours during this time (which historically Sussex Police have approved but each is dealt with on a case by case basis).

It is highly likely that Sussex Police would raise a representation to an application on the terms you are currently proposing. The expectation will be on you as the applicant to show how you would mitigate any increased potential risk that your premises could bring.

I appreciate this may not be the answer you were hoping for. You are of course still within your rights to make the application and have it heard by a panel of Councillors if Sussex Police do raise a representation. You will have a chance to present your case and the panel will make a decision based on hearing all parties points of view/evidence.

Operating until 2am 7 days a week is particularly important for us during Ramadan, as this time coincides with the period when individuals observing the fast need to break it and have access to nourishing meals. This service will cater to the local community, including students and residents, by offering a convenient, accessible option for late-night dining. It will also foster a welcoming environment for those observing Ramadan while providing an additional amenity for students who often study or socialize late into the night.

Being open until 2:00 am is crucial for our franchise model, as it not only increases revenue potential but also strengthens our brand’s presence and reliability, ultimately contributing to our growth and success.

5.  We aim to accommodate both dine-in and takeaway customers. We offer a comfortable seating area (30 covers) for those who wish to enjoy their meals on-site, while also providing efficient takeaway options for customers who prefer to order and eat on the go and we also provide delivery within a 5 mile range radius.

6.  Yes, we will be on just eat / uber eats / pepes app and website only.

7.  For delivery collections, we will instruct drivers to park on Caledonian Road in the designated motorbike bay, located conveniently across from the premises. Alternatively, drivers may use Franklin Road, directly opposite the shop. This approach is intended to minimize congestion on Lewes Road and reduce noise pollution for the local community, including students residing above the premises. We are committed to ensuring our operations are considerate of our neighbours and the surrounding area. We are currently in the process of building the shop and have recently received planning approval from Brighton Council.
